Legal notices regarding data processing

Based on Article 13 of the Swiss Federal Constitution and the data protection provisions of the Federal Government (Data Protection Act, DSG), every person is entitled to protection of their privacy and protection against misuse of their personal data. We adhere to these provisions. Personal data is treated as strictly confidential and not sold to third parties and/or only disclosed to third parties (Reka, Echonovum, Dextra) with your consent.

In close cooperation with our hosting providers, we strive to protect the databases as best as possible against unauthorized access, loss, misuse, or falsification.

When accessing our websites, the following data is stored in log files: IP address, date, time, browser request, and general information transmitted about the operating system or browser. This usage data forms the basis for statistical, anonymous evaluations, so that trends can be recognized, enabling us to improve our offerings accordingly.

On some pages, you may be asked to provide personal information. Answering these questions is voluntary. Sensitive data is not transmitted via email. Your data is exclusively stored for processing your requests; disclosure of member data to third parties (Reka [name, address, and date of birth for accessing Reka credit], Echonovum [email address for voting], Dektra [name, address, phone number in the event of the enforcement of legal protection insurance]) is done with your consent. You have the option at any time to prohibit the use and/or disclosure of your data by email or by postal mail.

Kapers assures that your information will be treated confidentially in accordance with applicable data protection regulations.

Confidentiality of User ID and Password

Keep your user ID and password confidential. Do not store your user ID and password in your browser, and do not use cloud-based password tools. Always log out from the password-protected member area of the kapers website after each session.

Member Data

kapers requires the following data from you to fulfill its tasks: Name, address, phone number, email, employee number, airline, base, 3/4 letter code, and your entry date.

All further details can be voluntarily supplemented. Many of the additional details are valuable for kapers for political activities.

Access to member data is restricted and granted only to individuals who require access to this data for their work and are contractually bound by data protection regulations.

Disclosure of Member Data to Third Parties

Members consent to the disclosure of member data to the following partners:

  • Reka - Swiss Travel Fund (Name, address, and date of birth for accessing Reka credit)
  • Echonovum (Email address for voting)
  • Dextra Legal Protection (Name, email address, telephone number for extended legal support) Members may refuse the disclosure of member data to third parties at any time.

Data Storage and Retention

Upon leaving kapers, data will be completely deleted or anonymized, unless there is a legal obligation to retain it, outstanding claims exist, or individual details are still being used for statistical purposes.

In this regard, the data:

  • of an applicant will be deleted no later than 2 years after submission.
  • of a departed, excluded, or deceased member will be deleted/anonymized at the end of the financial year + 1 year.

If data has been shared with third parties, we request these entities to delete this data. To this end, we have made binding agreements.

Use of Cookies

When visiting this website, no temporary files or cookies are stored on your computer in the publicly accessible area. However, if you log in to the members' area, cookies will be stored, which are valid for 1 hour. You can block cookies or similar technologies in your browser settings. Doing so may affect your use of this website. We recommend deleting stored cookies and temporary files in your browser after visiting our website.

Furthermore, we recommend not storing form data or passwords in your browser.

Jurisdiction

The exclusive place of jurisdiction for all legal disputes relating to these terms and/or the use of the website is Zurich, Switzerland.

Partial Invalidity and Applicable Law

If any of the present conditions are annulled, declared invalid, or voided, the validity of the other conditions remains unaffected. Furthermore, the present conditions and the use of this website are exclusively subject to Swiss law.

Anonymization

For statistical purposes, data is anonymized or pseudonymized to the extent possible.

Anonymization means: The data can no longer be attributed to the individual to whom they belong. Pseudonymization means: While working with the data, it is not evident to whom they belong. The individual is referred to – instead of their real name – with a number or a fictional name. Whether personal data can be anonymized or pseudonymized depends on the purpose for which the data is needed.
